You could just pay it and watch your insurance rate go up $50 a month for the next 36 months. You could go to traffic school, but why waste it when you could win with a Trial by Declaration.
Every California moving violation will cost you one DMV point against your license and about $50 more per month on your insurance for the next 3 years.

You can get the TBD forms by downloading them off this site, Click on - Trial by Declaration Forms - or “Traffic Self Help”.
- You don’t have to contact the court to get the forms. You can file the TBD form with bail, by mail (send certified, return request receipt) before your first court date or by asking for an extension and filing it with bail, before that date.
- You can also file your TBD with bail if it’s 10 business days before your court trial date.
You may waste your time and money by going to court and asking the judge to let you file a Trial by Declaration.
Here are a few ways to win with a Trial by Declaration:
- The officer may fail to file his response (Officer’s Declaration).
- The officer may not remember the facts and not file his response.
- The officer only has 30 days to file his answer, if he’s late, you win.
- If the officer has filed his response, the case may be dismissed because your law defenses knock his evidence out.
- The officer may not appear at trial.Many officers fail to show up for trial and you win.
Why do they fail to show up? Who knows? Was he Tired, on vacation? Doesn’t really care? He can’t remember the facts?There are more human reasons than can be counted.
The list of ways to win because of officer lapse, conscious or otherwise, is endless.
I’ve seen so many dismissals in traffic court. One time there were at least 80 people in court and every single case was dismissed because of some emergency and the officers had to respond to it.
You can file the Trial by Declaration yourself. You do the whole thing by mail.
You fill out the simple two page form, fill it out and mail it! That’s it.
My advice would be to not “shoot yourself in the foot.”
